FIANCE(E) VISA
A K-1 Visa, commonly referred to as Fiancé(e) Visa is one of the nonimmigrant visas that are issued to the fiancé(e) of a U.S. citizen. This visa makes it possible for the visa holder to enter the U.S. for up to 90 days before he/she gets married and files for Adjustment of Status to become a green card holder. Once the adjustment application is filed, the K-1 visa holder can stay in the U.S till he/she gets the green card. If the K-1 visa holder has an unmarried child under age 21, a K-2 nonimmigrant visa may be also available to the child.
Any U.S. citizen with the intention of marrying a foreign national who is outside the U.S. may apply for the K-1 visa. Applicants should know that to apply for the K-1 visa, both the petitioner and the beneficiary must be free to marry. This means that both of you are single. Also, all prior marriages must end through divorce, annulment or death.
There is also a two year clause that states that the petitioner must have met his/her fiancé(e) in person within the last two years prior to the commencement of the K-1 application process.
This requirement can only be waived if meeting the non U.S. citizen’s fiancé(e) in person would violate a long-established customs or traditions, or if it would create extreme hardship on the U.S. citizen.
